1 - SUBJECT.

1.1 The object of these Conditions of Sale is the purchase of products and services made remotely via computer through the site www.gemhub.it, belonging to GEM HUB MILANO S.R.L.S. with registered office in Via Luigi Settembrini,50 20124 Milan.

2 - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

2.1 The contract entered into between GEM HUB MILANO S.R.L.S. and the Customer must be considered concluded with the acceptance, even partial, of the order by GEM HUB MILANO S.R.L.S. This acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to Him during the purchase procedure, and to fully accept the general conditions of sale.

2.2 If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of art. 50 et seq. of Legislative Decree 206/05.

2.3 Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order is excluded.

3 - MODE OF PURCHASE AND PRODUCT AVAILABILITY

3.1 Before confirmation of the purchase will be summarized the total cost of the order to the Customer, and He will have the opportunity to change in whole or in part, or completely cancel such order.

3.2 Product prices are shown on the site excluding VAT.

3.3 The cost of transportation will be added at the time of the conclusion of the order, the amount of which may vary depending on the delivery method requested, unless exceptions and exceptions are specifically posted on the site.

3.4 The cost of transportation for destinations outside the Italian territory are clearly specified to the Customer before the conclusion of the order itself.

3.5 GEM HUB MILANO does not guarantee the continued availability of products at the conditions offered, remaining committed in case of unavailability, to contact the Customer by phone or e-mail for possible replacements or refunds at no additional charge.

3.6 The Customer's response regarding an email notification of missing items from their current order must be received no later than 4 days. Otherwise, the order will be processed automatically by deducting the missing items, resulting in a refund of the latter in case of prepayment.

3.7 GEM HUB MILANO S.R.L.S. reserves the right to change the prices shown on www.gemhub.it without notice.

3.8 The surfaces of 925 silver smallware and jewelry are subjected to specific treatments. Oxidation disappears over time, and the speed of this process depends on how the items in question are treated. Sweating, perfumes and other chemicals (soaps, creams, etc.) cause galvanic deterioration so we encourage customers to remove jewelry before washing, going to bed or playing sports. Polishing cloth (normally commercially available for purchase) turns out to be an excellent way to give new luster to jewelry that has dulled/oxidized over time. In any case, the loss of galvanic intensity is not a defect but rather a normal and inherent condition of the aforementioned metals.

4 - SHIPMENTS AND PAYMENTS

4.1 Shipping and payment methods can be seen on the "Shipping and Payment" page. The times indicated for delivery terms are purely indicative and are in no way binding for GEM HUB MILAN.

4.2 GEM HUB MILANO will deliver to the Customer, at the address indicated by the latter, the products selected and ordered.

4.3 GEM HUB MILANO is not responsible for damages or delays in delivery caused by the carrier to the purchased products, remaining totally unrelated to the relationship between the same carrier and the Customer.

4.4 Shipping costs can be found on the 'Shipping and Payment' page.

4.5 All billing and destination data must be filled in correctly and completely by the responsible Customer. Any errors in entering incorrect or incomplete billing data will be the sole responsibility of the Customer. Any errors in entering the wrong or incomplete address may cause delivery problems and generate storage costs that will be charged to the Customer.

4.6 All prepayment methods must be received no later than 4 days after order confirmation, otherwise the order will be cancelled automatically.

4.7 Payment methods are as follows:

Cash on delivery: Payment on delivery to the courier with additional charges.
Credit Card
Paypal
Bank Transfer: The shipment will start as soon as the payment is received (2-3 days approx.)
Collection at the showroom: The products will be collected by the customer at our showroom in Via Luigi Settembrini, 50 20124 Milan 20124 following notification by email

5 - RESPONSIBILITY

5.1 GEM HUB MILANO assumes no responsibility for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes, earthquakes, floods and other similar events that would prevent, in whole or in part, the execution of the contract in the agreed time.

5.2 GEM HUB MILANO shall not be liable to any party or third party for damages, losses and costs incurred as a result of the non-performance of the contract for the above causes, the consumer being entitled only to a refund of the price paid.

5.3 GEM HUB MILANO is not responsible for any fraudulent and illegal use that may be made by third parties, of credit cards, checks and other means of payment, when paying for products purchased. Gem Hub Milano, in fact, at no time during the purchase process is able to know the buyer's credit card number which, by opening a secure connection, is transmitted directly to the manager of the banking service.

5.4 GEM HUB MILAN is also unable to know the data provided to the lender, since at the time of choosing this means of payment, a secure connection is opened to the buyer, transmitted directly to the lender itself.

6 -RESIDES

6.1 In the event of a lack of conformity GEM HUB MILANO will, at no cost to the Customer, send the products to be replaced. Any defects already present upon delivery of the material must be communicated GEM HUB MILANO within 5 days of receipt of the same by e-mail to info@gemhub.it, indicating the details and photographs of the defect found. In the event that GEM HUB MILANO is not able to replace the product the same may proceed to its consensual replacement with a product of similar or superior characteristics to that disputed or the refund of the amount paid by voucher. The customer is required to ship at its own expense the defective product at the Seller's operational headquarters by sending it to GEM HUB MILANO Via Luigi Settembrini,50 20124 Milan.
